Lincoln County man charged with assault, kidnapping

A woman told authorities she was kicked, punched, choked and bitten during an assault in Lincoln County Sunday.

Benny Ray Garrett Jr., 47, of Lincolnton, is charged with felony second-degree kidnapping, assault inflicting serious injury and assault on a person by strangulation inflicting serious injury.

Garrett was placed in the Harven A. Crouse Detention Center in lieu of a $75,000 secured bond. Garrett is on federal probation after recently being released from federal prison, authorities said.

The woman told Lincoln County Sheriff’s deputies that Garrett picked her up shortly before 5 p.m. Sunday and took her to his residence. She told deputies they began drinking and Garrett began to assault her.

She tried to leave the residence several times but Garrett stopped her, Lincoln County officials said.

Around 9 p.m., she was able to get away and ran to the parking lot of a theater on North Aspen Street and called 911, officials said.

When Lincoln County EMS and deputies arrived on the scene, the woman was partially clothed, bloody and injured.

She was transported to Atrium Health-Lincoln where it was determined she had a broken spine and broken ribs along with bite marks and severe bruising.

Detectives executed a search warrant at Garrett’s residence on North Aspen Street, and they had to breach the door to get inside, officials said.

Garrett was taken into custody and admitted he manhandled and “roughed up” the woman, authorities said.

Investigating officers are Detectives K. Harrington and J. Lail along with Baker District deputies.
